CertPunch Terms of Use

These Terms of Use (“Terms”) govern access to and use of the CertPunch website, mobile applications for iOS and Android, APIs, study content, and related services (together, the “Service”). “CertPunch,” “we,” “us,” and “our” refer to the operator of the Service under the CertPunch name.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the higher minimum age required in your country to consent to an online service. If local law requires consent from a parent or legal guardian, you may use the Service only with that consent.

You must be legally able to enter into these Terms. Use on behalf of an organization does not give that organization ownership of a learner’s personal account unless a separate written agreement says otherwise.

2. Accounts and authentication

Access to the mobile app requires an authenticated account. Depending on the platform and configured providers, you may:

  • create a CertPunch account using your name, email address, and password;
  • sign in with Google; or
  • sign in with Apple.

A local CertPunch account must have a verified email address before it can enter the product. You must provide accurate account information, keep your credentials confidential, and promptly update information that changes.

You are responsible for activity performed through your account unless it resulted from a failure of the Service’s security controls. Notify us at support@certpunch.com if you believe your account has been compromised.

CertPunch may require your current password or a recent provider authentication before a sensitive operation. Changing a local password, changing a verified email address, signing out, or deleting an account may invalidate sessions on one or all devices.

3. The study service

CertPunch provides practice questions, explanations, progress tools, and links or references intended to support independent study. Available vendors, certifications, exam variants, questions, and media may change as content is reviewed, corrected, added, limited, or removed.

An authenticated account does not guarantee access to every item ever created or stored by CertPunch. The product may release content gradually. The current version does not promise a paid entitlement, subscription, in-app purchase, or pay-as-you-go access. If paid functionality is introduced later, its price, scope, renewal terms, and any additional conditions will be shown before a charge is authorized.

The Service may require an internet connection to load a new exam or current content. An interrupted study session may remain recoverable on the device, but we do not promise that every feature is available offline.

4. Certification and educational disclaimer

CertPunch is an independent study tool. Unless a page explicitly says otherwise, CertPunch is not affiliated with, endorsed by, or an official testing product of the certification vendors whose names or marks identify the subject of study.

Practice questions, scores, pass marks, progress, XP, streaks, and other indicators are not official examination results and do not predict that you will pass, qualify for, or receive any certification. Certification rules, objectives, prices, scheduling, and passing requirements are controlled by the relevant vendor. You should verify current requirements with that vendor.

Content can contain mistakes or become outdated. Please report material errors through the contact route above.

5. Permission to use the Service

Subject to these Terms, CertPunch grants you a limited, personal, non-exclusive, non-transferable, revocable permission to use the Service for lawful study and evaluation.

You may not:

  • access or use another person’s account without permission;
  • bypass authentication, access controls, content-release limits, rate limits, or security measures;
  • extract, scrape, copy, republish, sell, or distribute substantial parts of the Service or question collection except where applicable law permits it;
  • probe, attack, disrupt, overload, or introduce malicious code into the Service;
  • use automated means in a way that harms availability or other users;
  • use the Service to infringe intellectual-property, privacy, or other rights;
  • misrepresent CertPunch practice results as official certification results; or
  • use the Service for unlawful, fraudulent, or abusive activity.

Nothing in these Terms prevents rights that applicable law does not allow a contract to restrict, including permitted security research or statutory exceptions where they apply.

6. Ownership and feedback

The Service, its original software, presentation, and original materials are owned by or licensed to the CertPunch operator and are protected by applicable law. Vendor names, certification names, and third-party marks belong to their respective owners. These Terms do not transfer ownership to you.

If you voluntarily send suggestions or feedback, you permit CertPunch to use them to operate and improve the Service without payment or confidentiality obligations. This does not transfer ownership of your personal data or content that applicable law says remains yours.

7. Third-party services and links

The Service may interact with Apple, Google, email-delivery providers, hosting providers, certification-vendor pages, YouTube, or other external services. Those services have their own terms and privacy practices. CertPunch does not control their availability or content.

8. Privacy

Our handling of personal data is described in the CertPunch Privacy Policy. The policy is part of the information governing use of the Service but does not reduce rights provided by applicable privacy law.

9. Suspension, termination, and deletion

You may stop using the Service at any time. The account settings provide a path to permanently delete an authenticated account. Deletion is irreversible and removes account-owned server data as described in the Privacy Policy. Deleting the app alone does not necessarily delete server data.

You may request deletion without the app by following https://certpunch.com/delete-account/. CertPunch completes verified deletion requests within 30 calendar days after confirming the requester’s identity.

We may restrict or suspend access when reasonably necessary to protect the Service, comply with law, investigate abuse, or enforce these Terms. Where appropriate and legally required, we will provide notice and an opportunity to appeal.

Sections that by their nature should continue after termination—including ownership, disclaimers, liability limits, and dispute provisions—remain in effect.

10. Service changes and availability

We may change, correct, suspend, or discontinue parts of the Service. We aim to preserve learner data and active-session integrity, but uninterrupted, error-free, or permanently available operation is not guaranteed.

For a material adverse change, we will provide notice when reasonably possible and required. These Terms do not promise that a specific feature or content item will remain available indefinitely.

11. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” CertPunch disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy where those disclaimers are legally permitted.

Nothing in these Terms excludes statutory warranties, consumer guarantees, or other rights that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by applicable law, CertPunch is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, certification fees, or losses caused by reliance on practice results.

Nothing in these Terms limits liability where limitation is prohibited, including liability that applicable law does not allow us to exclude. Consumer rights in your country remain unaffected.

13. Disputes and applicable law

No governing jurisdiction or exclusive venue is stated until the operator’s formal legal identity and address are approved for publication. Mandatory consumer and privacy laws that apply to you continue to apply, regardless of these Terms.

14. Changes to these Terms

We may update these Terms to reflect product, legal, or operational changes. The page will show the new effective date. If a change materially affects your rights, we will provide additional notice where required. Continuing to use the Service after an effective change means acceptance only to the extent allowed by applicable law.
